Nihoner.com (“Nihoner”, “we”, “our”) allows users to create, upload, and share content (notes, comments, forum posts, uploads, submissions). This Agreement defines ownership, licensing, and responsibilities.
1. Ownership
- You retain full copyright and ownership of the original content you create and upload to Nihoner.
- Nothing in this Agreement transfers ownership of your intellectual property.
2. License to Nihoner
By uploading or posting content, you grant Nihoner a:
- Worldwide, royalty-free, non-exclusive, sublicensable license to:
- Host, store, reproduce, display, and technically process your content,
- Distribute your content to other users within the Service,
- Modify, adapt, resize, or reformat content for technical, security, or usability reasons,
- Translate content into other languages when necessary for service delivery.
- This license is for the purpose of operating, improving, and promoting Nihoner.
Termination: The license ends when you delete the content, except that Nihoner may retain:
- Technical backups,
- Security archives,
- Copies necessary to comply with legal obligations, audits, or disputes.
3. Restrictions on Uploads
- You may only upload content that you own or are authorized to use.
- You must not upload content that:
- Infringes third-party copyright, trademark, patent, or privacy rights,
- Contains unlawful, defamatory, or harmful material,
- Is spam, fraudulent, or misleading.
4. Waiver of Moral Rights (Where Allowed)
- To the maximum extent permitted by law, you waive any “moral rights” (such as rights of attribution, integrity, or withdrawal) so that Nihoner can host, moderate, adapt, or reformat your content as needed.
- Where waiver is not permitted, you agree not to enforce such rights against Nihoner in a manner that interferes with service operation.
5. Indemnification
- You agree to indemnify and hold harmless Nihoner, its owners, and affiliates against any claims, damages, or expenses arising from content you upload, including third-party copyright or IP infringement claims.
6. Promotional Use (Optional with Consent)
- With your explicit consent (e.g., when you post a testimonial), Nihoner may display your content in marketing, case studies, or promotions.
- You can withdraw such consent at any time by contacting [email protected].
7. Enforcement
- Nihoner reserves the right, at its sole discretion, to:
- Remove or disable content that violates this Agreement or our Community Guidelines,
- Suspend or terminate accounts of repeat infringers,
- Preserve evidence for legal purposes.
