Nihoner does not pre-screen all content. Users are solely responsible for their contributions.
2. Our Liability & Safe Harbor Protection
Nihoner.com is an educational and hosting platform. We are not responsible for user-generated content.
We claim safe harbor protections under:

3. How to File a Copyright Complaint
If you believe your rights are infringed, submit a written notice including:

- Identification of the infringing material (specific URL on Nihoner.com).
- Your full legal name, postal address, telephone, and email.
- A statement of good faith belief that the use is not authorized.
- A statement, under penalty of perjury, that your notice is accurate and that you are authorized.

4. Removal of Content
- Upon receipt of a valid notice, we will remove or disable the material.
- We may notify the user who uploaded it.
- We reserve the right to remove content without prior notice if we suspect infringement.
- We reserve the right to refuse restoration even if a counter-notice is submitted.
5. Counter-Notice (U.S. & International Equivalent)
If you believe content was wrongly removed, you may submit a counter-notice including:
- Your name, address, signature,
- Identification of the removed content and its prior location,
- A statement, under penalty of perjury, that the removal was due to error or misidentification,
- Consent to jurisdiction of the courts in Warsaw, Poland, and (if applicable) the U.S. Federal Court for your district.
Filing a counter-notice means you accept full legal responsibility if your statement is false.
6. Repeat Infringers
We maintain a zero-tolerance policy for repeat infringers.
- Users with multiple valid complaints may be permanently banned.
- Accounts terminated for infringement are not eligible for refunds.
- We may block associated IP addresses, payment methods, or emails.
7. Technical Measures
We may use automated tools (e.g., fingerprinting, keyword detection, AI-assisted recognition) to identify infringing content.
We do not guarantee these tools will detect all infringing material. Users remain fully responsible for compliance.
8. International Scope
This policy applies worldwide, including but not limited to:
- United States (DMCA compliance),
- European Union (Copyright Directive, Digital Services Act),
- United Kingdom (Copyright, Designs and Patents Act 1988),
- Canada (Notice-and-Notice regime),
- Australia (Safe Harbour provisions),

9. Reservation of Rights
Nihoner reserves the right to:
- Remove, disable, or block any content at our sole discretion, with or without notice,
- Terminate accounts for any infringement or suspected infringement,
- Refuse refunds to users whose accounts are terminated due to violations,
- Disclose information to rights holders, regulators, or authorities if required by law.
